Discuss the divorce process in a Muslim country. What are the causes of divorce in Kuwait? Why are divorce rates increasing? Is divorce a sign that that family roles and expectations are changing?
Divorce in Islam, as said, "The most hated permissible thing for Allah is divorce." Islam does not forbid divorce, but hate it. There are some marital problems that do not end just in divorce and for this reason Islam allows divorce. Grounds for divorce in Kuwait are the same reasons that to be possible in most Arab countries. One of the main causes of divorce in Kuwait is an incompatibility between the wife and the husband's mother. Kuwait's relationship not only the husband and wife, but includes the people of the husband and wife's family as well. Also the second reason for divorce is lack of respect for the wife to the husband or the husband to the wife. Our society is a male society where the wife must respect her husband. But we go back to the law on personal status law in Kuwait is always going to be with women. Also, with the openness that occurs now, the women are taking their freedom in everything. Now women do not accept that men do things that they do not want. Times have changed and no longer as the past. Women now have the voice and have the right to say their views, as well as women now can take their right from any man who was.
Of course, we can not deny that divorce has a significant impact on the family and the roles of the family. It makes the construction living in one place and parents live in another place far away from them. Sometimes after a divorce, we find that the father and mother married to others and this leads to fragmentation of the children and therefore they lost. This leads to the loss of family and therefore the loss of society.

It's true divorce rate are increasing in Kuwait, it could be because of misunderstanding, husband or wife unable to be responsible towards her/his family or children, husband/wife sometimes spend most of their time at work and not paying attention to family needs but the most common reasons are lack of trust and if the husband is unable to handle his family's needs, funds or any other issue concerning his family and that will lead the wife to feel unsecure which will lead to divorce. The lack of trust before it was only women having doubt about their husbands but now men also have doubt about their wives and sometimes don't trust them so the lack of trust in marraige could be from both sides.
In any Muslim country the divorce process is the same. The foundation is I shall say the same. However, some countries depending on what sort of laws they follow will differ in the process of divorce. Countries such as Tunisia and Morocco follow slightly different procedures when it comes to divorce. What happen during the divorce process is that the man first has to pronounce the word “talaq” meaning you’re divorced in order for the divorce to begin. He then has a trial period where he can change his mind, and get back with his wife before the process actually begins. I believe it’s a three month period, the logic behind that is if the woman is pregnant the man might want to change his mind regarding the divorce. However, if the wife does not want to stay with her husband then the process begins. Now if she decides that she would like to stay with her husband, and they were able to reconcile their differences that is up to them. Then the man can only pronounce the word “talaq” twice after the first time, and the same thing happens, until we reach the final time. You are allotted three in total. After the final time, the divorce process is automatic, and the man cannot get back with his wife, until she has married someone else and stayed with him for a couple of months, and realized that she does not want to be with this other man can she get back with the husband that divorced her. Again divorce would be at the disposition of the new husband. The causes of divorce are many; they range from marital problem, to abuse, and incapability of learning to love one another. Additionally people are forced to get married and that causes much dilemma. Some people resort to marriage as a way to escape from their families, only to find out that married life isn’t any better than the previous life she had, which results in divorce. Also people romanticize the idea of marriage a great deal, they think it’s all about the wedding ceremony, then the honeymoon, and then party like rock stars, but when the news hits them that marriage is not easy, one needs to understand commitments they get dislodge from this fantasy like concept and seek a way a out; that is divorce. Abuse is also another reason why people seek divorce, some people are just not marriage material, and they still have a backward like thinking, which causes the women to ask for divorce, or even the man. I think sometimes divorce might be the best choice. When people are married at a young age they do not really know much about responsibility, nor have they really found out what they want from this life. They need to actualize, or understand their preferences. Cheating is also a cause of divorce, and again this seems to be a result of enforcing marriage at a young age, and people not knowing what they want. As people evolve families evolve, and the shift becomes evident. The question becomes whether the repercussions are negative or positive. Expectations might seem to be minimized at a certain level, additionally; people will have to refashion what it means to be a family along with the constraints imposed by Islamic regulations regarding both parties.
Divorce in Islam is permitted if both couples agreed upon it, still is not really likeable due to its negative circumstances. The causes of divorce in Egypt would be many. They cannot really be listed. Prior marriage, some couples would imagine that marriage would be exactly like the love stories seen on TV and the romance they have been always waiting for and couldn’t practice it fully. So, as soon as they get married and once they start facing the real life, things collapse and they realize that marriage isn’t as easy as they thought and that they were never ready for it. In some other cases, in fertility would be a reason. Marriage in Egypt is a reason for child brining, so infertility would be considered as one of the causes that wouldn’t really accomplish reason behind that marriage. So, divorce would be a solution. Other problems, such as jealousy, immaturity of either or both of the couples, social pressure, and financial pressure.
Divorce is increasing in Egypt due to the increasing of financial pressure on families (increase of poverty line). The financial pressure on families causes a lot of problems between the newly married couples, mother and father, and parents and kids. Once the newly married couples face financial problems, they fail to further sacrifice their both living standards that they have been use to. As a result, they both feel that their marriage have turned out to be a failure and haven’t added but instead decreased their living standard that they have been always living in. When it comes to the families, older generation, both parents get to be more mature than the newly married couples. Still, the family problems rises due to the increase of prices and increase of home demands that the parents or father would usually fail to satisfy. These family problems make their children would want to marry and live the romantic relationship as an escapism technique from the lack of love and fights back at home. At both cases, the parents might end up divorce or the kids might end up hurrying for marriage and then get divorce.
I can’t really see how divorce is a sign how the family roles and expectations are changing in Egypt. From my own opinion, I believe that divorce is heavily related to the financial and economical problems in Egypt. The family role in Egypt is still not changing where marriage is still simply defined as “two couples are in love and want to get married to get kids.” The family is still responsible to fulfill its role as a family where its responsible to provide the kids with security, finance, care, and love. So, I don’t really think that divorce is a sign for the change of family role and expectations of a family.
Although divorce is not really encouraged in Islam, it is permitted. The process is for the husband to say in arabic "divorce" and would have a sort of 3 month break to decide whether if they want to go for the divorce. This is because in case the wife is pregnant, there will be no confusion who the child belongs to and another reason is if one changes their mind they are able to be back together. In Islam, we are permitted to divorce three times, after the third time the divorce is official and if the husband wishes to be back to his wife, she would have to marry someone else and get divorced to be able to do so.
Despite the small population the divorce rate is very high in Kuwait, its the fact that people rush into marriage. Since in our society pre-marital relationships is not encouraged and frowned upon many would rush into marriage, and once married the flaws are noticed and the couple would realize how they are not a good match and would divorce. Our generation lack in patience, in older generations couples tend to compromise and try to make things work but today people are impatient and would find the easier way out by getting a divorce.
In Kuwait married couple are like people in pre-marital relationships in Europe or the States, but the only difference couple that break up from a relationship are single while in Kuwait they would gain the title of divorce and unfortunately for divorced women its difficult to get married again after a divorce. One must keep in mind that marriage is a big step dont rush into it at such a fast pace.

In islam divorce is allowed, and it is said that it is also "makrooh" meaning its "halal" or allowed, yet hated. However, when the couple are facing problems and are not able to live peacefuly with each other, divorce is encourged. The Quran has clearly stated the terms on which a divorce may occur. In Sorat Albaqara God says : " Divorce is twice. Then, either keep [her] in an acceptable manner or release [her] with good treatment. And it is not lawful for you to take anything of what you have given them unless both fear that they will not be able to keep [within] the limits of Allah . But if you fear that they will not keep [within] the limits of Allah , then there is no blame upon either of them concerning that by which she ransoms herself. These are the limits of Allah , so do not transgress them. And whoever transgresses the limits of Allah - it is those who are the wrongdoers(229). If a man divorces his wife three times, she has to get married to another, then if she divorces him, she is allowed to take her former husband.
Divorcing is usually done by the man, however, a woman may ask to have the right to divorce her husband in the marriage contract.
In kuwait, the divorce rate has been increasing dramatically. there might be a number of factors, one of them i believe was that women now have more say and are more indipendent economicaly, unlike before when the woman was fully dependent on her husband. Therefore, women now are less likely to tolerate abusive and demanding hasbans. Also, a few years ago, divorce was not seen as a solution, if a women gets married then thats who she'll be with whether he was good and bad, and she wouldnt divorce him, fearing she'd bring shame to the family.
Also, i believe that divorce is increasing due to westernization and the idea of being in love before marriage. before all marriages were arranged, and people got married to those who were similar to them in all aspects;, family, tradition, and religious sect. therefore it is less likely to see many conflicts and clashes. now people tend to have partners of different sects and statuses for "love" and when they get married they realize the differences and their ideas and beliefs will clash. also a research was done showing that arranged marriages actually lived longer than marriages based on love in the Social Psychology book by david myers.
According to the Quran we learn that God does not favour divorces and in fact encourages the continuation of marriage. God has imposed prohibitions on certain category in marriage. Since marriage in Islam is a contract, it may be dissolved at any time. In addition, if a women get divorced; divorced women are entitled to stay in the same house she stayed before divorce. Also, if the couple reconciles after the first divorce and wish to be husband and wife again, they can re-marry. This is allowed for two divorce only. If the couple divorces third time they have to observe God's commandment.God makes it not-so-easy for the couple to divorce. This law serves as a deterrent for those who want a divorce for the third time and they would be very careful to take this step. "If he divorces her (for the third time), it is unlawful for him to remarry her, unless she marries another man, then he divorces her. The first husband can then remarry her, so long as they observe GOD's laws. These are GOD's laws; He explains them for people who know." Nowadays in Kuwait the word " Talaq" which means divorce is heard daily, the main reason is that womens voices are heard, and have the right to do whatever they want. To support that, "The divorce rate has been rising because of the change in women's status. The fact that women today have education and, more importantly, employment - which leads to their financial independence - makes them more willing to accept divorce rather than live an unhappy life," says Madiha Al Safty, a sociology professor at the American University in Cairo. And "as society [moves] away from the traditional model, a divorced woman is no longer as stigmatized as she used to be," she adds.
Divorce is definitely not acceptable by any person in the Muslim Community. As Allah mentions in the Quran that the relationship man and women share is very pure and no one should harm it. However, one does get divorced in the Muslim community. I feel people now are more educated; women have almost equal rights in the society. Before a women was suppose to listen to everything a man would tell her and it was her duty to obey him and thus, divorce rate back them was very low. Comparing it to today’s world, where women has a right to say and can distinguish between wrong and right-this causes her marriage on the borderline. We know have the media influencing us at all time. The television, the internet has affect on the ideas that people now portray. The thinking style has changed, people now think for themselves rather than others. It’s all about their rights and voice. If a woman raises her voice in front of her husband in the olden days, the husband would hit her or throw her to her parent’s house. Nowadays husbands cannot do anything to their wife’s as they are equally educated and earn almost the same living. Therefore, the authority figure is completely different. However, men are still the head of the family but it’s always the women’s decision that gets the roll in the family. Getting divorced in Kuwait is definitely not a good way to look at it. Usually a women and men are allowed to get divorced twice and re-marry again but they can’t re-marry the third time according to the law in Islam. The women is usually the seen as the victim in the case of divorce as it becomes very difficult for her to re-marry again to another man, as a lot of questions arise and a women’s image is shattered in the society. For men on the other hand, does not really become difficult. It is easy for him to find a wife easily. Moreover, within time the roles male and female share are also distinguished. They no more share roles of one being superior to the other. WE have always seen cases where the women is the one filling for a divorce as she find out that the husband is cheating on her or is beating her. She now has no fear towards her husband. Is it the changing society or is it the media to be blamed? It both actually society has changed itself with the flow of time and so has the media influenced as I have already mentioned earlier. Kuwait is currently going through a rapid change of liberalization, and divorces are becoming more acceptable than before. There still is this negative stigma behind divorces of course, but it is less so than say 10 years ago. Family expectations keep changing, and Kuwaiti women are becoming more liberal and independent, and are taking up jobs and working towards careers more than before, and this traditional structure of Kuwaiti women staying at home is slowly changing. A working woman would have the confidence now to push for a divorce in cases of marital abuse or in a case where the husband is caught cheating. Since the woman is able to financially support herself, she no longer feels helpless. I also hear that quite a few people rush to get married, and later discover that their partner is not their soul mate and that they can't live the rest of their lives with them. The Government has also recently implemented certain policies to help and support single Kuwaiti mothers, so this also encourages Kuwaiti women in difficult situations to have an option.
In Islamic law divorce is known as haram (sin) to such an extent that they have allowed polygyny to take place as the relationship between a wife and a man is known to be very sacred in many Quranic versus. The practice of divorce combatively is more in today’s world in the Arab society mainly because the western culture has really been improvised . Infidelity is not a major reason in Kuwaiti or Arab society as Islam still allows polygyny which gives man no reason to be infidel to his wife however in spite of this you still see many cases as such that result in divorce.

In a muslim country, the man can simply divorce his wife by saying, literally translated, "you are divorced" three times. This means the marriage is not legitimate anymore. No, because the women are not surrendering to the stereotypes that they should be home to stay home and take care of their husbands. Divorce is legal and it is in our religion but it is not the first solution because it's hateful. Nowadays divorce is more common than before and as we can see that the divorce rate is increasing every year. I think that there are many causes of divorce such as betrayal, disrespect, inability to take responsibility as a result of early marriage and must not forget the incompatibility of intellectual, educational and material between the couple may be a cause of divorce, and that forced marriage could lead to divorce, and in my personal opinion I think that extreme jealousy could destroy the marriage. In my opinion divorce might be a solution but it must not be the first solution because by divorce we are destroying the family bonds and we might be risking the psychological health of the children.
In Kuwait the people follow the Isllamic way of getting divorced. i believe that some of the major causes of divorce are Lack of consensus between the spouses, and it is an actual reason for the failure of the marital relationship. It's true divorce rate are increasing in Kuwait, it could be because of misunderstanding, husband or wife unable to be responsible towards her/his family or children, husband/wife sometimes spend most of their time at work and not paying attention to family needs but the most common reasons are lack of trust and if the husband is unable to handle his family's needs, funds or any other issue concerning his family and that will lead the wife to feel unsecure which will lead to divorce. However, some countries depending on what sort of laws they follow will differ in the process of divorce. Countries such as Tunisia and Morocco follow slightly different procedures when it comes to divorce. What happen during the divorce process is that the man first has to pronounce the word “talaq” meaning you’re divorced in order for the divorce to begin. He then has a trial period where he can change his mind, and get back with his wife before the process actually begins. I believe it’s a three month period, the logic behind that is if the woman is pregnant the man might want to change his mind regarding the divorce. However, if the wife does not want to stay with her husband then the process begins. Now if she decides that she would like to stay with her husband, and they were able to reconcile their differences that is up to them. Then the man can only pronounce the word “talaq” twice after the first time, and the same thing happens, until we reach the final time. You are allotted three in total. After the final time, the divorce process is automatic, and the man cannot get back with his wife, until she has married someone else and stayed with him for a couple of months, and realized that she does not want to be with this other man can she get back with the husband that divorced her. Again divorce would be at the disposition of the new husband.

Additionally people are forced to get married and that causes much dilemma. Some people resort to marriage as a way to escape from their families, only to find out that married life isn’t any better than the previous life she had, which results in divorce. Also people romanticize the idea of marriage a great deal, they think it’s all about the wedding ceremony, then the honeymoon, and then party like rock stars, but when the news hits them that marriage is not easy, one needs to understand commitments they get dislodge from this fantasy like concept and seek a way a out; that is divorce.
Abuse is also another reason why people seek divorce, some people are just not marriage material, and they still have a backward like thinking, which causes the women to ask for divorce, or even the man. I think sometimes divorce might be the best choice. When people are married at a young age they do not really know much about responsibility, nor have they really found out what they want from this life. They need to actualize, or understand their preferences.
Cheating is also a cause of divorce, and again this seems to be a result of enforcing marriage at a young age, and people not knowing what they want.
As people evolve families evolve, and the shift becomes evident. The question becomes whether the repercussions are negative or positive. Expectations might seem to be minimized at a certain level, additionally; people will have to refashion what it means to be a family along with the constraints imposed by Islamic regulations regarding both parties.
Divorce in Islam is permitted if both couples agreed upon it, still is not really likeable due to its negative circumstances. The causes of divorce in Egypt would be many. They cannot really be listed. Prior marriage, some couples would imagine that marriage would be exactly like the love stories seen on TV and the romance they have been always waiting for and couldn’t practice it fully. So, as soon as they get married and once they start facing the real life, things collapse and they realize that marriage isn’t as easy as they thought and that they were never ready for it. In some other cases, in fertility would be a reason. Marriage in Egypt is a reason for child brining, so infertility would be considered as one of the causes that wouldn’t really accomplish reason behind that marriage. So, divorce would be a solution. The financial pressure on families causes a lot of problems between the newly married couples, mother and father, and parents and kids. Once the newly married couples face financial problems, they fail to further sacrifice their both living standards that they have been use to. As a result, they both feel that their marriage have turned out to be a failure and haven’t added but instead decreased their living standard that they have been always living in. When it comes to the families, older generation, both parents get to be more mature than the newly married couples. Still, the family problems rises due to the increase of prices and increase of home demands that the parents or father would usually fail to satisfy. These family problems make their children would want to marry and live the romantic relationship as an escapism technique from the lack of love and fights back at home. At both cases, the parents might end up divorce or the kids might end up hurrying for marriage and then get divorce.
I can’t really see how divorce is a sign how the family roles and expectations are changing in Egypt. From my own opinion, I believe that divorce is heavily related to the financial and economical problems in Egypt. The family role in Egypt is still not changing where marriage is still simply defined as “two couples are in love and want to get married to get kids.” The family is still responsible to fulfill its role as a family where its responsible to provide the kids with security, finance, care, and love. So, I don’t really think that divorce is a sign for the change of family role and expectations of a family.
Although divorce is not really encouraged in Islam, it is permitted. The process is for the husband to say in arabic "divorce" and would have a sort of 3 month break to decide whether if they want to go for the divorce. This is because in case the wife is pregnant, there will be no confusion who the child belongs to and another reason is if one changes their mind they are able to be back together. In Islam, we are permitted to divorce three times, after the third time the divorce is official and if the husband wishes to be back to his wife, she would have to marry someone else and get divorced to be able to do so.

Since in our society pre-marital relationships is not encouraged and frowned upon many would rush into marriage, and once married the flaws are noticed and the couple would realize how they are not a good match and would divorce. Our generation lack in patience, in older generations couples tend to compromise and try to make things work but today people are impatient and would find the easier way out by getting a divorce.
In Kuwait married couple are like people in pre-marital relationships in Europe or the States, but the only difference couple that break up from a relationship are single while in Kuwait they would gain the title of divorce and unfortunately for divorced women its difficult to get married again after a divorce. One must keep in mind that marriage is a big step dont rush into it at such a fast pace.

However, when the couple are facing problems and are not able to live peacefuly with each other, divorce is encourged. The Quran has clearly stated the terms on which a divorce may occur. In Sorat Albaqara God says : " Divorce is twice. Then, either keep [her] in an acceptable manner or release [her] with good treatment. And it is not lawful for you to take anything of what you have given them unless both fear that they will not be able to keep [within] the limits of Allah . But if you fear that they will not keep [within] the limits of Allah , then there is no blame upon either of them concerning that by which she ransoms herself. These are the limits of Allah , so do not transgress them. And whoever transgresses the limits of Allah - it is those who are the wrongdoers(229). If a man divorces his wife three times, she has to get married to another, then if she divorces him, she is allowed to take her former husband.

In kuwait, the divorce rate has been increasing dramatically. there might be a number of factors, one of them i believe was that women now have more say and are more indipendent economicaly, unlike before when the woman was fully dependent on her husband. Therefore, women now are less likely to tolerate abusive and demanding hasbans. Also, a few years ago, divorce was not seen as a solution, if a women gets married then thats who she'll be with whether he was good and bad, and she wouldnt divorce him, fearing she'd bring shame to the family.
Also, i believe that divorce is increasing due to westernization and the idea of being in love before marriage. before all marriages were arranged, and people got married to those who were similar to them in all aspects;, family, tradition, and religious sect. therefore it is less likely to see many conflicts and clashes. now people tend to have partners of different sects and statuses for "love" and when they get married they realize the differences and their ideas and beliefs will clash. also a research was done showing that arranged marriages actually lived longer than marriages based on love in the Social Psychology book by david myers.

Nowadays in Kuwait the word " Talaq" which means divorce is heard daily, the main reason is that womens voices are heard, and have the right to do whatever they want.

Divorce is definitely not acceptable by any person in the Muslim Community. As Allah mentions in the Quran that the relationship man and women share is very pure and no one should harm it. However, one does get divorced in the Muslim community. I feel people now are more educated; women have almost equal rights in the society. Before a women was suppose to listen to everything a man would tell her and it was her duty to obey him and thus, divorce rate back them was very low. Comparing it to today’s world, where women has a right to say and can distinguish between wrong and right-this causes her marriage on the borderline. We know have the media influencing us at all time. The television, the internet has affect on the ideas that people now portray. The thinking style has changed, people now think for themselves rather than others. It’s all about their rights and voice.

Nowadays husbands cannot do anything to their wife’s as they are equally educated and earn almost the same living. Therefore, the authority figure is completely different. However, men are still the head of the family but it’s always the women’s decision that gets the roll in the family.
Getting divorced in Kuwait is definitely not a good way to look at it. Usually a women and men are allowed to get divorced twice and re-marry again but they can’t re-marry the third time according to the law in Islam. The women is usually the seen as the victim in the case of divorce as it becomes very difficult for her to re-marry again to another man, as a lot of questions arise and a women’s image is shattered in the society. For men on the other hand, does not really become difficult. It is easy for him to find a wife easily. Moreover, within time the roles male and female share are also distinguished. They no more share roles of one being superior to the other. WE have always seen cases where the women is the one filling for a divorce as she find out that the husband is cheating on her or is beating her. She now has no fear towards her husband. Is it the changing society or is it the media to be blamed? It both actually society has changed itself with the flow of time and so has the media influenced as I have already mentioned earlier. Thus, divorce is seen as a sin in Islam. As the relationship the couple share is suppose to be of love and trust not hate and betrayal.

ReplyDeleteFamily expectations keep changing, and Kuwaiti women are becoming more liberal and independent, and are taking up jobs and working towards careers more than before, and this traditional structure of Kuwaiti women staying at home is slowly changing. A working woman would have the confidence now to push for a divorce in cases of marital abuse or in a case where the husband is caught cheating. Since the woman is able to financially support herself, she no longer feels helpless. I also hear that quite a few people rush to get married, and later discover that their partner is not their soul mate and that they can't live the rest of their lives with them. The Government has also recently implemented certain policies to help and support single Kuwaiti mothers, so this also encourages Kuwaiti women in difficult situations to have an option.
In Islamic law divorce is known as haram (sin) to such an extent that they have allowed polygyny to take place as the relationship between a wife and a man is known to be very sacred in many Quranic versus. The practice of divorce combatively is more in today’s world in the Arab society mainly because the western culture has really been improvised . Through this you can see how because of the western world the family roles and expectations are changing. For starters women are now much more literate then olden times . They are literate enough to make decisions for their own selves and how they can now rebel against their husband and backfire if they think that they have a stand against the topic.

A women now protests against her husband if he is aggressive towards her unlike how it was before when a women never had a say in anything that her husband does.
Infidelity is not a major reason in Kuwaiti or Arab society as Islam still allows polygyny which gives man no reason to be infidel to his wife however in spite of this you still see many cases as such that result in divorce.

Divorce is legal and it is in our religion but it is not the first solution because it's hateful. Nowadays divorce is more common than before and as we can see that the divorce rate is increasing every year. I think that there are many causes of divorce such as betrayal, disrespect, inability to take responsibility as a result of early marriage and must not forget the incompatibility of intellectual, educational and material between the couple may be a cause of divorce, and that forced marriage could lead to divorce, and in my personal opinion I think that extreme jealousy could destroy the marriage. In my opinion divorce might be a solution but it must not be the first solution because by divorce we are destroying the family bonds and we might be risking the psychological health of the children.
